Please read these Terms of Use ("Terms") carefully before using DinerHub ("Service", "Software", "Platform"). These Terms govern your access to and use of our restaurant and hotel management software. By creating an account or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using DinerHub, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of a business, you represent that you are authorized to bind that business to these Terms. If you do not agree, you may not use the Service.
2. The Service
DinerHub is a cloud-based platform that helps restaurants and hotels manage orders, tables, kitchen workflows (KOT/KDS), billing, staff, expenses, customers, and business insights.
We may add, modify, or remove features over time to improve the Service. We will make reasonable efforts to notify you of material changes that affect how you use the Platform.
3. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use DinerHub for your internal business operations during your subscription term.
You may not copy, modify, distribute, sell, sublicense, reverse engineer, or create derivative works based on the Service without our prior written consent.
4. Accounts & Your Responsibilities
- You are responsible for the accuracy and completeness of the information you enter into the Platform, including menus, prices, taxes, and billing details.
- You must keep your login credentials confidential and are responsible for all activity that occurs under your account and the accounts of staff you create (such as managers and captains).
- You are responsible for issuing accurate invoices and for complying with applicable tax laws, including correct GST/GSTIN configuration on your bills.
- You agree not to use the Service for any unlawful, fraudulent, or unauthorized purpose, or in a way that could harm the Platform or other users.
5. Fees & Payment
- Access to paid plans requires payment of the applicable subscription fees described on our pricing page or in your order.
- Unless stated otherwise, fees are billed in advance and are non-refundable except where required by law or expressly stated.
- We may revise pricing with reasonable prior notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new fees.
- A free trial, where offered, may be cancelled at any time before it converts to a paid plan.
6. Your Data
You retain ownership of the data you and your customers submit through the Service ("Customer Data"). You grant us the right to host, process, and use Customer Data solely to provide and improve the Service, as described in our Privacy Policy.
You are responsible for obtaining any consents required from your own customers for the data you collect through the Platform (for example, customer names and phone numbers used for orders).
7. Intellectual Property
The Service, including all software, design, text, graphics, logos, and other content (excluding Customer Data), and all related intellectual property rights, are and remain the exclusive property of DinerHub and its licensors.
8. Service Availability
We work hard to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control, such as internet or third-party outages.
9. Limitation of Liability
The Service is provided on an "as-is" and "as-available" basis without warranties of any kind, whether express or implied.
To the maximum extent permitted by law, DinerHub shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data arising out of or relating to your use of the Service.
10. Termination
- You may stop using the Service and cancel your subscription at any time from your account or by contacting us.
- We may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to others or to the Platform.
- Upon termination, your right to use the Service ends. We may retain or delete Customer Data in accordance with our Privacy Policy and applicable law.
11. Governing Law
These Terms are governed by the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.
12. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
